Tricky question on OEM suspension

You guys all know how on standard OEM suspension the car sits slightly higher on the driver side. This was the case with my msport E36, same with mine non zsp E90.

It's barely noticable but it's there, and BMW confirms it's for a reason.

Now my question is - is there something particular about their shocks-springs OR it's somewhere else. In other words, when getting aftermarket shock-spring combo, is the car still bit jacked up on driver's side or not? And if not, is that good or bad since you ignoring some bit BMW intended to be there... OR this only matters a tiny bit on race track.
