It could be a heat issue. On a cold start it works great. This is even my second radio. I dont really want to buy one from the dealer ($800) because im afraid it will do the same thing. They wont cover it under CPO either.
non BMW battery is fine and it doesn't need to be programmed (specially) to the ECU. Just make sure the battery has sufficient capacity and that its capable to supplying its rated current. Have the alternator and voltage regulator checked.
I've heard of 2006 radios having display issues/failures.
