quick update, i eventually wrote a letter to the customer service director of BMW UK explaining my displeasure at the service from BMW, quoting the precedents set on this site & others re goodwill for this problem

They now agreed to cover 80% of the part costs so i have had the work done for 309

not great but better than the original 465 quoted

so if anyone else is having probs write a letter
