To get summer tires you actually need to specifically select them or get the sport packackage, which clearly mentions summer tires in the list of items. So in either case it is reasonable to assume you know that you have summer tires (read - you cannot sue BMW if you crash).

But there is indeed an issue - what if you are doing ED in winter and want a sport package - are you screwed? I don't think many will appreaciate having to worry about buying an additional set of tires during a vacation in Europe...

Edit: just noticed that rep told you that you'd be getting all-seasons. I sounds like an irresponsible moron to me (I mean the rep) - I'd be pissed too. On the bright side, you have summer tires and oil cooler. Driving a BMW with all seasons is like playing piano in rubber gloves - it only seems fine to you if you have no idea what you are doing...
