I think they check to see how much play is in the flywheel. Mine was replaced, however my brand new 320d judders from the day I bought it. Only very slightly not quite as smooth as you would want it but i find it a distraction and still really pleased with it. From having driven 4 different 2litre bmw diesel engines it's something to expect when owning one. With my driving style at least.
