From what we know, the '07 335i's w/ sport package and manual trans. had a factory oil cooler. Yours is a step, so it probably doesn't have one. You can do the Dinan flash, but if there are any damages as a result of the software, it will not be covered under warranty. The only way, at this point, to keep your warranty would be to purchase the Dinan Oil Cooler that we also have on special. Dinan will warranty the software(including any consequential damages) as long as there is their oil cooler or BMW's original factory oil installed on the vehicle.
