The reason there is nothing in the "Note" column for BMW and Mercedes is not because they are still eligible, it is because they never sold enough diesels to reach the phase out thresholds. The credit expired for
ALL diesels on December 31, 2010 whether or not they reached the phase out thresholds.
I purchased my 2011 335d in December 2011. I was not eligible to claim the credit as it had already expired.
I purchased both a 2010 VW Jetta Sportwagen TDI and a 2010 VW Golf TDI in 2010. I claimed $3000 of tax credit on my 2010 tax return.
