Makes sense to me. This is the exact reason why we needed to see the SIB - it is totally silent about out of warranty repairs.

I'd start referring to BMW's discovery of the "seep" as a leak that wasn't repaired.

I'd say something along these lines "BMW found a leak before my warranty expired but didn't repair it at the time. Now, 2000 miles later, the leak has gotten substantially worse and I request that it now be repaired under warranty."
