I believe in most cases it's up to the judge at the court proceeding (if it went to court that is)... they decide what is 'fair' in their opinion given both your situations.

If your that worried, get a pre-nup... or just don't get married... not sure there's much in the way of positive tax breaks nowadays although could be wrong on that one, never had to find out!
