If they never notified you about this while you owned the car, you should be able to get this handled. It definately won't be easy though. I'm assuming you had the car advertised as having the remaining factory warranty which unfortunately drags you into the problem.
Good luck with this one. I've been lucky with my car, but hearing all this crap about warranty claims makes me not want to buy a new BMW ever again.
