Have they stripped your gearbox down and inspected the parts? This is what they'd usually need to do to confirm its broken. If your car has always been maintained by BMW (servicing e.t.c.) then you can apply for a goodwill gesture (i.e. 100% parts and 50% labour paid by BMW UK). The dealer would have to do this.
