My car is a sedan and the '09 is a coupe with the sports package. Mileage is about the same but I would be giving up 1 year of warranty.

I believe you are trading INTO trouble. Didnt BMW make major engine changes in 11? 09 was not good.....injectors twice, hpfp, steering rack, pump&hoses x2, etc etc.
