I wouldn't worry about it too much. You can get one of those steering wheel immobilizers for the time being.
I find it hard to believe that the dealer a cannot recode the unlock/lock codes. If this was the case you would be able to unlock any E90 with a different fob...although unlikely, it sounds like BMW uses standard codes for unlocking/locking the car. Find the right code and you'll be able to unlock that car...
