They could always say that they don't hear anything when they test drive it, but atleast you will have BMW documentation of the problem and that if they follow procedure they should be re-imbursed by BMW for performing the warranty work. FYI - I have the same problem but a good service department is 2 hours round trip, so I am just dealing with it for now. Will eventually take it in with the TSB (technical service bulletin) in hand.
