Here's another suggestion in case you really want to keep the car. Why not ask that the dealer (I am assuming it's a BMW dealer) give you an extended warranty (Gold Plan) or CPO it for 6 years/100k miles? That would help you out in the future in case something pops-up due to the accident plus make the car more desirable at resale.

Right now, it's a windfall for the dealer. They will be doing the repair work and will probably charge the insurance company through the nose making a hefty profit. Meanwhile, you'll end up with a car that's been in a pretty serious accident. Not a fair deal in my opinion.

Oh, don't forget to demand a check from the other guys insurance company for the diminished value of the car.
