In regards to BMW, currently at a stumble! They are not playing ball whatsoever and are telling me to take it up with my insurance even after explaining that they rejected the claim. My car was manufactured in 2010 and barely covered 17,000 miles - so it's surely covered by warranty.

How do I approach BMW about this? I keep being routed to a call centre for EU customer services and they aren't much help at all!

No way this can be proven. Even to 51% likelihood.

I would sue both insurance as BMW under a theory of joint and several liability in that they are each responsible and can battle share the damages between themselves.
