how hard is it to pull that lower cover off? and if it is a bad switch what are my steps on fixing this? i pulled back on the pedal to see if it wasn't coming all the way back up or something and it all seemed fine but brake lights are still on...

You will have to pull the lower cover under the driver's dash area to see the brake pedal switch. Ensure nothing is hanging up and holding the pedal down, even a 1/4" will turn the brake lights on. Aftermarket stereo or additional wiring up under the dash is typically quite shoddy and could be the cause. Otherwise it would be a bad switch.
