There is a section in the letter that says if you do not like the settelement you can object to it without removing yourself from the class. Maybe that is what the 2007 model year owners should consider doing. It is section 11 and gives the details of what you would need to do.
That's what I'm going to do. I received this class settlement letter a couple days ago. It states BMW may cover turbo wastegates for 12 mo/12,000 mi. I want replacements or extended coverage. These turbos were the only reason I had considered an extended warranty but didn't get one.

Quisp you might know: When did BMW start using updated turbos for the N54? In 2008? I want to refer to those in my objection letter

Objection to what? I don't want their money! I want extra warranty for the turbos. Did you see the proposed payout?

1 HPFP - $100.00
2 HPFP - $200.00
3 HPFP - $300.00

... etc etc..

That's the payout for any out of pocket expenses the owners incurred.... Shit! I'd rather trade $500 of their money for extra 4 years of warranty!

Make sure your car has had HPFP and injector recall campaigns performed. Check this with your nearest dealer. Also, update your contact information with BMWNA. That's the only way to make sure you receive any important correspondence.

I was not aware of them using updated turbos but you may want to ask around on that one.

Had about 57K when they replaced it. Its not that big of a deal of its just a little noise, but I don't want that to turn into bigger problems.

Wow I guess I made the right decision when BMW offered to buy back my 335i in exchange for signing liability waiver papers. They sold me my M3 near invoice and gave me back 2 years worth of payments minus mileage and fees. All in all, I walked away with a new M3 and a check for 15k.

I have smoke coming out of my left tail pipe, from turbo failure. I wonder if this will be covered. I am going to call my dealership today and see what they say. I have 67k miles on my car its a 08.

I just talked to my SA and she says they wont replace anything in terms of my Turbos because they arnt seeing any codes. She also stated that if they do replace my turbos the have been using USED turbos to replace my existing turbos.

Hmm, I re-read the letter this morning (with a clear head) and I think you are correct! I will object to the proposed settlement, even though I've not spent a single penny out of pocket on this issue, yet...

Neither have I but it doesn't take much effort to try to get this extended. I'm going to request BMW matches the hpfp warranty w/a turbo warranty, especially for 2007 and early 2008 N54's. Sometime in 2008, BMW started installing turbos w/8mm actuator arms v. the 6mm arms on the early cars.

Ok so basically this letter is just for people who have paid for the repairs out of pocket?
