"Lemon Law" in Europe?

Hello,

We have a problem with a BMW of us.
As I see on the internet, there is a law in the US for returning the car to the manufacterer (lemon law).

Does anyone know if there is such a law in Europe (Belgium?)?

Kind regards,
Danny

If there is any, it's definitely not as "protective" as the US one... I think you'll have to prove your points with legal experts and so on. I remember when I was a kid, my dad's M635csi was clearly a lemon and we went through hard times for BMW to take it back (but it was some time ago ).

Good luck with that "affair".

BMW NA does not get dragged into lemon law cases because they are proactive in putting customers into new or replacement cars if a truly severe problem exists.

What is the problem with your car?

Where are you talking about?
It's a law regarding new cars with problems
------------------------------------------------

The problem we have is with a 630i convertible.
1. Massive electronic failure (Complete shutdown of idrive, inside lighting, not starting).
2. Hard shifting from gear 5 to 6.

The car is from april 2006 and has been in service for over 13 times.
They have placed like 3 new computers.
We have requested an extra year of warranty, BMW refused.
So now we want the car replaced or refunded.

The car has not been fixed.
It still produces the same problems.

Hi,

In the UK we have the Sale of goods act which works in a similar way to lemon laws. I think that there is a European wide act - try searching for 'Directive 1999/44/EC of the European Parliament and of the Council of 25th May 1999 '

Good luck and hope this helps.

In the UK the car would probably be too old to 'reject' under the Sale of Goods Act, this needs to be done very early on in ownership, like the first couple of months I would suggest. I think the best the OP could hope for would be that BMW take it back and exchange for a car of a similar spec and age. I would consult a lawyer and get him/her to write to the dealership in the first instance to explain the case and get everything in writing.

What dealership you have bought it from? Did they offered any help to you?
Folks, remember that especially in Belgium the attitude and quality of service is different from what you are used to in the US.

I've been living in Belgium for 2 years now and believe me I know what I'm talking about. Patience seems to be a big virtue in this country. (Wierd!)
