Check his lights

I once saw on a forensics show that a light broken while on looks totally different than one broken while off. If it's on, the element will burn up and leave soot all over the glass.
If it's possible, and you're really sure the lights were off, get a look at his car - or get an expert to take a look. Might take a lawyer to find an expert and get access.

Hey, you just need to come up with a witness that says his lights were off and that he was speeding. That's all the insurance company needs. Don't ask me how I know.

Sorry bro, it seems like it would be your fault. The 750 had the right of way as you were pulling. As far as a police report, here in MD, they don't do full blown reports unless someone is transported to the hospital or a vehicle gets towed. Otherwise, information is exchanged between the parties involved.

What the hell? No police report for an accident that caused so much damage (could be ~$10k judging by the picture) plus the damage to the 7? That's a lame rule. I know nothing about CA law, but check that out yourself to be sure. The last thing you want is a lazy cop not helping out with the proper paperwork.
Yup, no report unless there are injuries. They might give you a reference number detailing why they were called out but nothing too official.

if you record a phone convo without telling the person ahead of time, it actually violates wiretapping laws.

Depends on the state. Some states only require one of the parties to give permission.

Mine was even more damaged and it took them about 4 weeks, 13 thousand damage, I took it to a BMW certified, its the best because they have to take it to the dealership to get the codes off and align the headlights etc..Looks like new now.
Good luck, hard to believe his headlights were off because like everyone else said the lights would turn on automatic if its a newer model.
