So I took my 2009 335i in for maintenance at Shelly Bmw and my SA informed me with a SIB printout [SI B01 02 12 PDF download] showing that the turbos warranty have been extended to a whopping 8 years and 82,000 miles (for problems caused by wastegate).

This is on top of the HPFP 10/120k warranty. I guess Im going to skip that extended warranty purchase!! The only other critical part are the injectors but those are cheap now. $120 each and its not like all six would simultaneously fail.

Models Covered:
  • E60, E61 (MY 2008, 2009, 2010): 535i including xDrive E71 (MY 2008, 2009, 2010): X6 xDrive35i
  • E82, E88 (MY 2008, 2009, 2010): 135i
  • E89 (MY 2009, 2010): E89 – Z4 sDrive35i
  • E90, E92, E93 (MY 2007, 2008, 2009, 2010): 335i including xDrive


Edit: I believe BMW AG saw this lawsuit coming miles away and prepared themselves. I think how they prepared themselves was very smart. First, introduced the N55 engine immediately into the 2011 line-ups in the existing E90 models. Secondly, for those wishing to have N54, since there was technically still a prized market for it, introduced a secondary model called 335iS. These two changes completely eliminated any legal liabilities with regards to turbos, wastegates, or injector issues since the majority of the class action lawsuit was being represented by N54 owners in the 2007-2010 years.

INFORMATION

All issues relating to the last-minute appeal have been resolved and the new effective date of the settlement is July 11, 2012. The court-approved settlement provides the following relief to the Settlement Class Members’ vehicles listed above.

SITUATION

BMW NA has agreed to extend, to a total of 8 years or 82,000 miles, whichever comes first, the emissions warranties covering the Settlement Class Members’ vehicles for any failure of a turbocharger caused by a defect in a turbocharger wastegate. The terms of the original New Vehicle/SAV Limited Warranty and applicable emissions warranty still apply. BMW NA will not provide warranty coverage to any Settlement Class Member’s vehicle containing modifications or alterations to the turbocharger or its wastegates (software, hardware or otherwise), or evidencing other conditions not normally covered under the original New Vehicle/SAV Limited Warranty or applicable emissions warranty.

Modifications excluded from warranty coverage include any aftermarket parts that affect the turbocharger system, or if there are other conditions that would normally exclude it from warranty coverage.

WARRANTY INFORMATION

The emissions warranty for the turbocharger wastegates has been extended to 8 years or 82,000 miles, whichever one occurs first, for a failure of a turbocharger caused by a defect in a turbocharger wastegate that does not otherwise fall within exclusion to coverage under the warranty. Any applicable TeileClearing or Diagcode requirements still apply.

The turbocharger wastegates’ 8 year/82,000 miles warranty supersedes any applicable coverage provided under the BMW Certified Pre-Owned program or any BMW Group Vehicle Service Contract in effect. This component’s warranty extension applies to the above-listed models only. It is applicable to eligible vehicles which are registered and operated in all 50 states. The existing warranty coverage for all other parts has not changed.

BMW is informing all eligible Settlement Class Members of their extended turbocharger wastegates warranty.

Because as it turns out in this great country of America, the lawsuit was held and filed in California and only applies to citizens of California. Not citizens of the United States of America.

Go figure, Im sure our founding fathers would've like to change this one.

This is pretty recent news since it was made in July 2012 just last month. This means that if anyone of you ever get turbo trouble, fear no more because the dealers are more than happy to fix it and give you new turbos free of charge.

Sorry about those who arent in CA. Maybe you can open a PO Box and change your residence address to it to qualify.

No no!! This does NOT apply to 2011 owners with the N55 single turbo 335i.

You are screwed on that since the lawsuit was specific to N54. This only applies for MY2007 to 2010 N54.

This has zero to do with the lawsuit and everything to do with CA emissions control laws! In CA, for any car that was originally sold in CA, emission-related parts are warranted for 8 years and 82,000 miles. If you have a CA car, look in your maintenance book -- it's right there.

Emissions warranties in other states vary -- you need to check your state.

BTW, injectors are "emission related parts" in CA as well.

No, this has to do with the lawsuit. Turbos weren't warrantied under emissions period even in Cali. The lawsuit changed that to follow Cali's emissions warranty period but accross all states, not just Cali. BMWNA is going to warranty the turbos in the same way as the HPFP, same accross all states.

There is another thread in engine section that has been following this lawsuit for months now since BMWNA lost the suit.

From a guy that was going to buy the extended service plan for around 2k, this makes me happy. I'm sticking with CPO.

Only other thing I'd be worried about is the tranny. Don't think CPO covers.

I just paid the dealer to replace the front turbo to (finally) fix my wastegate rattle. Id love to see proof that the warranty is extended so I can try to get my money back!

Who knows what is going on?

I'll have to check my maintenance book again, but I am 90% certain that the list of covered parts for my 2008 model includes the turbos. Maybe what is being covered in addition due to the lawsuit is the wastegate rattle problem, which wouldn't really affect emissions. I do know the settlement specifically mentioned the wastegate issue.

this is 100% this time? because im pretty sure like a month ago one of these came out and like a day later the court reversed the order or something.

Yes, this is legit! Like I said, my service advisor at the BMW dealership informed me this morning with her print-out from her computer. The print out mentions this warranty extension, specifically the numbers 8 years, 82,000 miles.

It is 100% Legit as it can be. The SA brought it up to me, I didn't.
