Wait wait wait, let me get this straight. They are telling you the warranty started in 2006, when the car was built, and thus ended in 2010? And per the central database that the dealership accesses, your car's VIN says its in-service date was 10/14/2008 (meaning the first day it was sold to its first owner)?
So based on this logic, let me pose a hypothetical situation: If a dealership orders a new model year car from Germany, and it arrives and sits on the lot for a year and a half before being sold, the dealership can only offer the remaining two and a half years of the 4-year/50k new car warranty to its first owner?! That's ridiculous. Again, unless you're not telling us something (or you don't know something) about the history of this car, I would be pressing this point until I was blue in the face. It may be the difference between $5-15K, and free. |

OP, time to get a lawyer. In service date is 2008, when they had the car they should have fixed everything under warranty. Get a lawyer then post an update (when the case is over). Open the yellow pages there are 1000000s of lawyers out there. Consultations are free and bring in your paper work.

So then why won't you make an appointment with an attorney? The link I provided you clearly shows when the warranty starts. Your invoice in post 35 shows you brought it to them before it expired but they wanted to charge you instead of fixing it under warranty. You rather buy an engine without even asking a lawyer if you have a case? I feel like you are not telling us something.

I don't have the time or patient for legal action. If I really was under warranty I don't see my they wouldn't tell me. I have called bmw na and they told me I was out of warranty in December 2010. I will call them again to see exactly what date the factory warranty started for my car, then we'll see if it makes sense. The lady I talked to said it started in 2006 can't remember the exact date though. Will update you guys, in the mean time looks for an engine as close to 50,000 miles as possible and budget of $3500-$4500.

The burden is on them to PROVIDE with the paperwork showing you an in-service date BEFORE 2008. If they don't provide it to you then I say they lied to you and hire an attorney. You can have your attorney write them a letter demanding that they repair the car otherwise you will have it repaired and sue them for damages. Your attorney can give them a certain time to respond (15 days?) so you are not waiting forever and you can take steps to have your car fixed. Naturally, the choice is yours, but keep in mind, dealers are know as "stealers" for a reason.
