Not sure the FSA will be interested to be honest; likewise an ombudsman. The FSA seldom get involved in this type of issue.

If their T&Cs were clearly indicated at the time the policy was purchased (and they haven't been changed after the event, without notification to you), they are simply acting in their best interests. Unfortunately, they don't align with yours.

And the 5 tyre maximum is simply their standard tyre policy where the majority of policy holders would normally have 5 tyres. It would seem "unreasonable" to limit it to 4, when most car users effectively have 5 tyres.

Good luck with your endeavours, but I don't think you are going to get far.

Buy a spare wheel/tyre and get them to fix it after the 12 months is up. Assuming you still have the policy then. Although they probably have a time clause too...

Ive just bought this insurance from my dealer as BMW will not offer an E92 335d M-Sport without RFTs. However if I can get 4 tyres out of it then its well worth the cost of £299. I understand your concerns that you arent getting exactly what you paid for, however its certainly saved you a bundle already right?

NO!!1...maybe i'm not be clear...

what i'm not happy about is the terms and conditions that doesn't cover me when i get another puncture in the same corner/ "location" !!!

Kevin, based on what you've written, my understanding is that 5 tyres would mean and include a spare tyre. Ignoring the fact that your car, my car, Porsches and various other cars no longer have spare wheels, some still do. The S5 still has a spare, albeit one of those narrow emergency jobbies.

In all honesty Kevin I think you'll maybe have to take this one on the chin as from what you've said, the insurance policy is like a ducks arse.........water tight. Least you're still in front overall.

Oh and next time make sure you haggle for FREE tyre insurance as part of the deal, can be done most times.

Yeah, the terms and conditions are a real bitch in this one....(I should have read carefully!...)...but I still think, there not that fair....

and I should have switch the tyres over!....
