FML right?

SO what i first thought to be an exhaust leak, BMW tells me is nothing out of the ordinary (they did two cold starts) and from my experience during a cold start there would be an EXTREMELY loud ticking coming from under the car. It would quiet down after the car warmed up, which is what made me think exhaust leak but they said no, so ok i can live with that. The NEXT DAY, as i start my car cold-ish, i hear another strange sound at startup. I rev the car up to aroun 2500 and hear this obnoxious ticking/clicking sound as it comes down in the engine bay, right where that first ticking i mentioned was coming from. After doing it a few times and since it's only on the way down i figure it's a wastegate. Another appointment at BMW, both the manager and a tech at the dealer say that it's absolutely normal. I find that extremely hard to believe and i said i've heard of other people with the car having the same exact problem and they were fixed under warranty. However, this dealer has told me that there's "nothing they can do". Any ideas? i'm open to suggestions on the best course of action to fix this problem considering after i insist they look at the waste gates, they just say "there's nothing we can do" with my 4 year 50,000 mile warranty.

BTW car only has 22k on it 80% of which is highway driving.

its the valve on the exhaust... look towards the rear driver side under neath the car and you will see a butterfly valve, disconnect the hose from the exhaust, zip tie it and tuck it into the rear bumper.

or it might be his waste gate and they need to replace his actuator arm. Believe me U HAVE TO BITCH LIKE A WOMEN to get it done it cost them money and alot of time to do it so they will try and not do it.

The sound from the engine bay as the revs come down is the wastegate rattle. They ought to fix it, but you may have to make a stink about it. Loud ticking sounds from under the car is something else. They all make a clinking sound like that, although usually only after shutdown when they're hot, not on a cold start. I have not heard of the exhaust butterly making noises, but perhaps it is stuck, who knows. Most people have disengaged that thing long ago.
