Catback exhausts & VA emissions

Most aftermarket E90 cat back exhaust systems eliminate the 2ndary cats. Since we have to do an emissions test every two years in VA, could this pose an issue during testing?

The secondary cats are not monitored. Removing those cats would not effect emissions what so ever.
