Passenger seat will not go as low as driver side; normal?

Searched and found people who had the opposite problem - but couldn't find any posts on my particular situation - 2011 E90 M-Sport power seats - there are no restrictions under the seat that would prevent movement etc...but in the full down position the passenger seat is noticeably higher vs. the driver side / is this normal?

okay maybe I should have asked my question in a different way....

"does your passenger seat lower as much as your drivers seat"
