I don't blame you for not reading the entire thread, but it's already been pointed out that this is no different to the car than installing an aftermarket exhaust.
FWIW I've been running like this for over a year now. What's more, I've been to the dealer 2 times for routine service and they never said anything.

hrm any E93 owners have insight on how they found their wire? My hands are tired from prying into the trunk and not finding it =(

FYI, I was talking with my dealer about what might void the warranty, and they said anything aftermarket could possibly if it is found to have caused the problem. He gave an example of a 2009 335i with a full exhaust system that threw some code eventually and they couldn't do the warranty work because of it.

It is quite common for a dealer to refuse to do warranty work on a modified car if the modification may be related to the problem. There are many members who have been told by their dealer that work cannot be performed on their car unless it is returned to stock. Once returned to stock warranty work can proceed. (I'm talking about exhausts)

To completely deny/void a warranty claim based on an exhaust flapper, BMW would need to prove that an open exhaust flapper specifically caused damage. What is more, (assuming you plug it back in when you goto the dealer) they would have to prove that YOU unplugged it and absolutely rule out a bad connection.

Voiding warranty based on tuner codes is a totally different story.

I said an aftermarket exhaust voided their warranty. Threw a code for an engine problem. Not talking about just the flapper as you weren't in your claim an aftermarket exhaust wouldn't void the warranty.

I unplugged it and noticed no sound increase just exhaust fumes. Its possible my intake already overpowers the small increase in tone.

Can this be combined with the ball bearing version of the mod?

In other words, instead of crawling under the car and inserting the ball into the vacuum line at the muffler, do the same where the vacuum line connects in the trunk.

Easy access and no codes = best of both worlds.

Anyone tried this?

The ball bearing has the same effect according to what I've read, but it is less reversible than the Tee.

I did not read this entire thread but the few pages I did it would seem several had the question of, "what does the flap in the exhaust do?"

When you start the car it closes to help bring the o2 sensors up to temp. Then opens after x temp is reached on my E46. I would think it does the same here. None of my after market cats have had one that I know of.

Just did this today, I walked out of my office with my suit on and it took me 20-30 seconds. My point is, you don't get dirty and you get do and reverse (if you don't like it) in minutes, any time, any where.
I love it, I was able to hear a big difference. Deeper lower sound. It went from vriiim to VROOM!!!!!

Stock exhaust w/ Magnaflow 4" angle-cut resonated tips welded on. Here's what the exhaust actuator mod sounds like on a cold start:

Did this mod 30 minutes ago. I drove to class and it does sound better. I'm pleased, it was very easy to do. I just hope the dealer doesn't say anything about it. My mpg didn't go down and I didn't notice a difference in torque like some people say.
