Traffic Ticket: Trial of Written Declaration?

Hey guys, I got a speeding ticket at Irvine going 83 in the 65 zone a while ago. The ticket payment is due on 1/28/2009. I was wondering if any of you guys had any experience with fighting the ticket by Trial of Written Declaration. It is when you write a letter with an option graph of the situation and try to justify what you did. I have already signed up for ticket assassin and I would like to know if it is worth it for me to do that. Some of my friends told me that the judge might not give me the chance for traffic school if he rejects me, but Ticket Assassin says really rarely does that happen. Usually people get traffic school. So if you have any related experience, please let me know! I don't mind writing a letter to fight it but I also don't to risk the chance of not having traffic school if it is very likely. I got a ticket going 90 in a 75. Used TA...submitted my TBWD and eventually won.

The key was to first ask for extensions. Then ask for TBWD. Submit it, based on the info on TA website. Then hopefully things go your way. I even got my *bail* amount refunded.

I got a speeding ticket for going 92 in Bakersfield. Used TA and won. Like Magmd mentioned, ask for extensions. Drag out the case and be patient. Good luck man.

Good advice but sometimes the website won't let you extend the case. I tried calling the court but I was always put on hold. I even waited 3 hours for an operator but nobody ever answered.

So if you are local go to court and take care of your shit before you leave for school and things get inconvenient.

You can ask for extension by writing, make sure to mail it certified. It has been awhile but I'm pretty sure that's what I did. I remember TA's website has all the necessary forms. You can also check the appropriate court's website.

I would wait until after the Christmas rush is over and the court is fully staffed again. The extension is 3 month btw.

I received a speeding ticket in my 328i back in March. I've requested as many extensions as I possibly could, and now my trial date is at the end of Jan. The goal to extend it as long as possible is that you hope the cop doesn't show up or his schedule or location has changed. I still have a few more tricks up my sleave (flashing a CA BAR ID work wonders in the LA metro court house) but it'll most likely be dismissed, even if the cop is there

I'll have to post my entire process of what I did after it's all said & done.

My ticket was in Kern county, maybe that's why. Or maybe they changed it so we can't drag out the cases for too long.

ya you are probably right. The due date is still a month from now, do you think I should do it when it gets closer to get a better chance of them approving? Or it doesn't really matter, I can get it approved anyway and since the 45 days is added onto the original due date not the date I request it. thanks again Frank!

Yes, you are right. You are entitled to the extensions but give yourself enough time. Just don't request for it on the last week. Other than that you should be fine. Good luck man.

Good luck Long, I just submitted the extension via OCCOURTS.ORG and got approved and extended until 3/16/2009. Should I still submit the bail amount by the original court date by 1/28/2009 or the new date at 3/16/2009? And when should I ask for the trial by written declaration? Thanks!!

I believe you submit the bail amount at the time you submit your written statement.

1. You should ask for paperwork to mailed to you, so that you can fill out and submit your "written" declaration. You should do this with plenty of time, so that you can return it before your court date.

2. Attach check to that form for the bail amount.

3. Wait to see if you won.

And the form is there for me to download and fill out, should I still ask for the forms? And also, when I ask the court for the paperwork, would they notify the police that I am planning to request a TBWD? Or it is after they received the filled out paperwork that is when the police finds out? Thanks!

The officer is sent the forms once you request it to be done by mail. I am not sure if it is done exactly the time you request or after you submit. You are both given a chance to write your version of the story within a certain time frame. Of course, yours will say NOT GUITLY b/c of xyz. The officer has to state why you are GUILTY. The court will decide who wins. If you never submit anything...you are automatically GUILTY. If the officer never submits anything...you are automatically NOT GUILTY. Just do your part, do not worry about the officer.

Sure, sounds about right. Maybe I will request for the forms around a month before my extended court date to drag it out with the officer as long as I could. Also, do I just write the letter to the court address with my citation number and request for the paperwork? Thanks

Hey guys. Great forum. I actually just signed up for Ticket Assassin as well, and paid the reg. I have not received an email with the link to the members area or the site owner's email address for consulting. For those of you who signed up for TA, how long did it take for you to receive the emails with the info?

E90330iS and SteveMondragon, how did your tickets go? Did you post what you guys did? Were you both successful in fighting your tickets? Would love to know your strategies. Thanks.

My Written Declaration was rejected. I just paid the fine after and took traffic school. I remember the cop said he will definitely show up to court and since my written declaration was rejected it further proved that the cop was on it. 2 more months then I am out of the 1.5 year probation for another ticket!
