No, I don't think it's right at all that you have to pay...they should really compensate you by a) giving you a new intercooler that fits, and b) paying for atleast 50% of the costs you had to endure

F__k 50% of the costs. He should be reimbursed 100%.

Unless they had already shipped the product when the OP made the initial inquiry.

Is that option available in the US? If so, the product page on the website should ask the buyer if they have this option before placing it in their cart.

Maybe they didn't know.

I feel sorry for you.
They should reimburse you for all the shipping and other expences you paid because of the wrong product. Also they should ship you the coreect product Free of charge.

As an Active Autowerke dealer, I can definitely vouch for them in terms of their commitment to customer service and taking care of any issues. I would contact Active first to see if there was a mistake in your shipment, they will no doubt correct any mistakes or problems with the order.

I would have to hear (read) AA's side of the story before I passed any judgement....but if you can show proof of the timeline....then you would have a very strong arguement for full compensation.

Here's the timeline that would be best for you: hypothetical of course:

1) you ordered the IC on the the 1st (or whatever)
2) you had a question regarding fitment, so you e-mailed (not called) within a few days....well before the order shiped.
3) They respond to you by e-mail (again....no phone call) within 24-48 hours...but again...well before it shipped.

At this point, if the above is the way it went down....then hell yes you have a right to full compensation.

It all depends on the timeline of your correspondence, and if you have doccumentation....such as e-mails.

Dear Sebastian,

I do believe the arrangement was fair. We can offer you refund for the intercooler + 1/2 freight since the processor works fine. I cannot refund the items you will be keeping. As far as the intercooler not fitting we have sold several intercoolers to international customers (some on this forum) and there were no fitment issues. We were not aware of the Active Cruise control being an issue since we do not have that here in the States and none of our international partners mentioned it being an issue.

I do apologize for the inconvenience and look forward to getting it sorted out.

Dear Board,

Not sure if everyone is on the same page, but Adaptive/Active cruise control is completely different than the cruise control offered on our cars here in the states. Someone can correct me if I am wrong but I do not believe BMW has begun offering it on US 335's. Maybe someone can expand on this topic. Thanks in advance.

I'm sorry, but the customer shouldn't have to go out of pocket for something that Active told them would fit. Offering half of freight charges is just not acceptable IMO, and shame on Active for screwing up and letting their customer eat cost. I guarantee you he won't be ordering anything from you anymore.

For a sophisticated shop like Active with a beautiful facility and bustling business, it's astounding that they won't cover the other half of freight. That's chump change in comparison to the good rep in business they'd receive from making it right. This is not right IMO.

I believe ACC is offered on US Spec cars as well. Isn't it a $2k option? All cars will have regular cruise control, I assume...

i know some ppl who have active cruise control in NY. roller84 for example, and his is a 335i

Makes sense. Thank you for clarifying. We find it strange that we have never had a complaint but after speaking with a couple shops they have mentioned installing the intercooler with the ACC. Thanks again.

We have offered a full refund of the product and freight.

They should Fully refunded the money and reimburse the Customer for Every thing. OP did every thing right. He did contacted the vendor and asked him all the questions. Vendor should have done the home work before answering the question and shipping the product.
