agree with everyone, have the manager put it in writing, I don;t trust sales, they will say anything they want to make a sales and get out of troubles, not on paper = they can lie and deny anything later

Talked to the business manager and he promised both an email and an official letter stating that the BMW warranty and maintenance started on the date of purchase.

Figured that would be the outcome. Russel is a very good BMW dealership, both from a sales and service perspective. They've always bent over backwards to be accommodating whenever I've needed anything. I think that's one of the benefits of living in an area with so many local BMW dealerships competing for business (Tischer, Russel, Passport, Towson, Bel Air, Northwest, Silver Spring, etc.).

Yea it can, the dealer is the agent of BMW USA and BMW USA is liable for any actions taken by that dealer. If the dealer sold a "new car' to a purchaser, BMW USA is on the hook for the warranty . . its recourse is only against the dealer. The hapless victim of the rogue dealer may go after BMW USA if the car is sold under misrepresented conditions.

no they are not liable. they can assist you and file a complain against dealer, but dealership makes the final call.

BMW of America only liable for their cars that are under warranty

You are misapprehending what I am saying. BMW USA is liable AS A MATTER OF LAW for the actions of its agent, in this case the dealer. Regardless, the true final say is from neither the dealer nor BMW USA, but a Court that has jurisdiction over the matter. Dealers do not get to scam a customer and walk away with impunity if the customer chooses to do something about it. There are civil penalites for doing so, including something most states have called the unfair trade practices act, or something close to it.

As I said before, one of the docs signed by a business manager states the car as "new". Also both the sales and business managers admited verbally that they'd misrepresented the car. So far I'm waiting on an email and letter confirming the full warranty/maintenance. I hoped I'd have an email by EOB today but it doesn't look it's going to happen today.
