vehicle contracts

I got a question maybe some of you who have the know how can give me some input.... if that make sense.

Anyways, I purchased my '11 X5 on Monday, signed paperwork and the finance person locked me in at 1.9%. I thought it was a done deal, again, everything signed.

Today, Thursday, the finance person calls me and said they made an error. It's supposed to be 2.9%. I asked if our contract was non-binding. She said "wellllll, yes and no" and goes into this BS about BMW would have caught it and yada yada yada.

Am I wrong to think that their error is just too bad on their part. They print up a contract, I sign, end of story...... NO?!

From being a finance manager, if the contract is printed at 1.9%, you can hold them to it, if you really want to. They may have legitimately made an error. If it was me, I'd make them renegotiate the price of the car to compensate for the percentage difference so your payments would come out the same.

BMW will catch it if it's wrong. The options are that they make the dealer eat the difference, which will probably happen, or they will simply deny the contract which means the dealer can knock a unit off of their sales totals for the month (which will probably not happen). Play it cool and don't be a dick about it, but in the end it is their mistake.

^^ Thanks, took the advise from both of you plus I called BMWNA. BMWNA said the same thing CIGARGUY, they should eat the mistake for their error.
The attorney said if the contact is signed, I have a legit case.

I presented that info to them, and after going back and forth a bit, they left the contract as is. They didn't like it at all and gave me a lot of crap about it as if it was my fault. Poor dealings on their end if you ask me, so I won't be going back there.

Thanks for the input though, I've never run into anything like this, and I learned a lot from it as well.

to sue them for one percent would hardly be worth the fees imho.
