Thanks, looking at the damage I'm hoping it will be written off. If it does then I'm thinking of getting rid of my classic mini and getting something stupidly impractical for a weekend toy and using the good ladies 1er day to day.

Il say a few bits 1st before i explain why i said it, theres hundreds of people doing this everyday who stage crashes and put premiums up they will always find a way to have a claim thats their "job" if you like, someone hit my dad in his car and tried claiming whiplash. So as for insurances going up you will never stop that.

The reason i said it was from my past experience, i was sitting at a set of traffic lights roughly 10 cars back on the bottom of a slight hill, i was in a mercedes sprinter 3 tonne van, stationary waiting for the lights i got hit up the ass so hard it shunted my van with me on the brakes 3-4 metres and bumped the car in front, the car that hit me was a vw touran, with that me and the 2 blokes in the van obviously not expecting it flew forward inside 1 without his belt on headbutted the screen. As it all happened so quick and no damage to the van as he hit the towbar and it being friday afternoon traffic in south east london i left him there. Felt fine until i woke up the next morning, and my neck and back were in bits, i felt like i had been 12 rounds with mike tyson. From that i missed 3 weeks at work as it had upset an old slipped disc, and i had a stiff neck for a week or so, at the time i was playing semi pro ice hockey and earning from that and i missed 6 games.
All in all my total losses were just over £3000. Now if i had of stayed there and police been called etc i would have been able to claim and gain my losses pretty much. But as at the time i think with adrenaline and a bit of shock i felt fine.

Thing is why should the OP be out of pocket when its not his fault, he will end up loosing excess, waste hours on end on the phone etc, then hours trying to find the right car again.
Glad he was fine and at the end of the day its a bit off metal.
1 more claim from someone who was actually in an accident is not going to affect any of our insurance premiums

Yes i can understand that, but if his going to end up out of pocket and possibly a car thats not what he had, why not have a claim? I have no problem with someone that actually gets hit in the back when not there fault should always claim, for the "companies" that do staged crashes its wrong and most of the time foreigners, these are the people that put our premiums up

Thanks for the kind comments gents. Looking at the damage I have a funny feeling that the car will be turned into a rather large paper weight. The good news is that it held up very well to getting shafted from behind by a 40ft lorry and the passenger compartment was intact.

I'll admit I'm in a bit of pain but I've felt worse after a game of rugby and unless I suddenly lose the ability to turn my head I have no intention of putting in a claim as it could impact on my job too.

Funnily enough that was one of the first things I removed from the car before it was recovered. I guess I'll just need to get another 6 cylinder car to replace it.

Well, I've just got a quote through for the repairs. The garage reckon it'll cost £14.8k so I'm guessing that it'll be written off.

What do you guys think I should be looking for as an insurance pay out?

What mileage is on the car? What factory fitted optional extras does it have (you can use the latter to fight from their first offer which will be very low and argue for more)

Does it have any additional stereo or etc in there?

It was sitting with just over 72k miles. I've had a look on Glasses and it says £13.4k trade in but I know I wouldn't be able to find a LCI 330d E91 with Pro Nav and leather for anywhere near that figure.

I think they write it off once repairs get to ~80% (maybe less) of the book value, so my guess is that you won't get it back.
