i've ridden with people who can't drive sober, how do you remedy that.

and for the record, when i got my dui, it was middle of the night, streets were empty, cops were perched outside. i would have made it home.

safe driver with some drinks in him > sober guy with crap reflexes who can't drive

There is another charge, DWAI, (.05 - .08) - driving while ability impaired-

It's a violation not a misdeameanor, but you will still get arrested, towed, etc.

Honestly its always best to just have a DD or cab it. And the time to decide that is before you go out.

I have a handful of friends who are state troopers and we dicuss this a lot. Im 135lb and i can drink 6 beers and blow well under a .08, that doesnt matter though. If you fail test you can still be charged. The test they do with your eyes is impossible to pass if you have been drinking. Its all up to the officer wether you get to go on or get arrested

6 beers in what amount of time? Close to waiving my BS flag. I have the tolerance of an ox and at 200 pounds and after 6 beers in a short duration I'd feel absolutely confident but definitely illegal (.08) to drive.
