What a bunch of cowboys. Small Claims Court is the way to go though mate.

I've never used the SCC myself, however I know a few people who have and they have never had to go any further then the threat.

The problem is that the dealership is clearly in a bad state and your cash might have just been used for the payroll!!

Paul, before you do that I would suggest that you get a solicitor to write a letter stating what you are prepared to do if the money is not forthcoming. Tell them they will be accountable for all costs involved so that they could end up paying far more than the £1000 owed.

Give them 7 days to pay, stating a final date for payment, send it special delivery so you have a record of who has signed for it, then use the small claims court if you get no joy.

Failing that, I can send some lady friends round to the dealership.

You know that's a pretty good idea, in exchange for beer tokens, get half a dozen of us on a Saturday (not open Sunday) to go in and swamp the sales staff with test drives, cups of tea and coffee....

Soon get fedup when the thtid Saturday in a row they made no sales

Last Wednesday I sent this after they still repeatedly refused to return calls and send a receipt for the deposit they "took".

Mike Flanagan is the MD of Blade Motor Group and Margaret Walters is his PA. It's the MD who is refusing to refund the holding deposit, Jonathan Cox is the Sales Manager and Dean Lucas the Salesman that took the holding deposit. I think because the Touareg was HIS car, it might have delayed him getting his Phaeton ???

Anyway, on the Friday afternoon I got a faxed copy of the receipt, credit card machine slip and their T&C's.

These have now been send to Barclaycard so they can persue, as they refused with out these documents.

If they don't get anywhere it'l be the small claims court, VW UK and Watchdog all getting a call/letter.

Grrrrrr.... maybe rogue traders should get a call....

Make sure you have EVERYTHING in writing - send a summary of what's happened so far in detail (every phonecall, letter, etc) in writing and keep a copy. Send it recorded delivery. Ask them to respond. Fax them the same letter - keep a fax log. They can be used in court (I have used them before) but it rarely gets anywhere near that if the realised you are clued up.

Mention any big website forums you regularly use. Imply threat but DO NOT actually threaten.

This has saved me 10s of £1000s in the past.

A shame though - those Touraegs are excellent!

Wouldn't take many of us to do that... the VW dealership is rather small. About 2 cars parked (in)correctly would do it.

The dealer that has behaved so badly is BLADE MOTOR GROUP, their VW showroom in Gloucester, Blade Volkswagen. Their reluctance to refund a holding deposit is outrageous and totally against their own terms and conditions. For three months I have tried to get the deposit back but they have not returned calls or emails. Blade Motor Group, Blade Volkswagen, Blade VW based out of Blade, Priory Road, Gloucester, Gloucestershire, GL1 2RQ, Tel: 01452 412000. Their group principle Mike Flanagan, Sales Manager Jonathan Cox and Salesman Dean Lucas are all avoiding speaking with me and my only contact is now with the principles PA Margaret Walters.

Personally I will not be buying any VW models until Blade Motor Group, Blade Volkswagen, Blade VW or any of their franchised showrooms selling Subaru, Alfa, Isuzu, Honda and Audi.
