E90 Manual Gearbox Help!

So I was driving home today and I had to make a quick getaway into traffic. As I pulled out I went from 1st to 2nd rather aggressively and 2nd gear disintegrated. I no longer have 2nd gear and it sounds like a cheap food blender. My car only has 23,000 miles on it and is a 2008. My question is if the gearbox is covered by warranty. Please let me know, thanks.

Wow! A 328 killing second gear from one shift? Very strange. I've been very tough on my gearbox many times and no issues here after 150k miles. Now my car has a Getrag not a ZF, but I don't think that makes a difference.

Just don't tell the dealer you changed gears "aggressively". Don't give them a reason to blame you.

If no codes are being thrown use Chevron Techron fuel injector cleaner (concentrate). It solves rpm fluctuating upon cold start-up. Also, for most BMW problems start off by scanning your car with the Peake Research Tool. It contains the actual BMW codes. If you want to register a newly installed battery for free (just buy a $10 cable) and google/download BMWLogger

Resolution

For everyone's future reference, I'll let you know how everything was resolved just incase someone has my same misfortune. Well BMW agreed to pay for the gearbox and didn't even bother taking it apart because it sounded like a blender (lucky me). My local dealership was kind enough to lend me a Mini Cooper s as my loaner (once again lucky me) and after one week I had an entirely new gearbox. The car drives great and I couldn't be any happier. BMW did a great job and I'm very satisfied with everything. I guess you always hear the horror stories on how the cars are never covered by warranty, well here's one positive story you can finally tell. Thanks for all the help on the forum guys!

Thanks for the update. So what exactly went wrong with the transmission?
