My BMW dealer is screwing me
So I recently purchased a 335i a few weeks ago and put the car down on coilovers. I also purchased a Cobb accessport. Unfortunately I couldn't tune because it has the original software rom version that cobb doesn't support. The solution seems simple. Take it to BMW and update the software version. Well because the car is "slammed" it becomes a liability issue and the refuse to work on the car... Has anyone ever experience anything like this? Or know any go arounds to this problem? Until the cars software is updated, I can't do jack in terms of getting more power..

Argue with them or take it somewhere else. They don't have grounds to do so.

The dealer cannot void your warranty. Read up on the Mag Moss Act and FTC report about warranties. They can only void the replacement of a warrantied part if your aftermarket part(s) caused the said failure. They also have to prove this versus conveying it verbally. in the OPs case his aftermarket suspension is not under warranty.
OP, some dealers will refuse to do work on a modified car and can do so if it does not involve the replacement of a warranty item that is no longer working. Try another dealer, thats your only option.

I have heard of other people having issues getting work done on lowered cars at the dealer - basically they just don't want to deal with it in case they damage it and have issues getting it on the lift.
They can't deny warranty work on the rest of the car just because the suspension is modified, but not sure how the law works with regard to just turning down the work completely - they are not saying you Voided your warranty or that warranty won't cover it, they are just saying they don't want the work. I would complain to BMW about it - not good business for BMW having their dealers turn down work on their customers just because they don't feel like working on your car!

Dealer didn't say the warranty would be voided. They were saying because it is "slammed", they are unwilling to work on it due to potential liability if they damage it. Or

You got coilovers, just raise car and lower it after? :
That would take less time than a 3hr round trip drive to another dealer. Not to mention fuel cost.

Yeah these are all good ideas. Problem is this dealership is small and it takes over a week to get an appointment. I'd rather drive it farther and get it done sooner rather than later. I'm in the army and my schedule is unpredictable. Thanks for all the input guys! Much appreciated. Ill keep everyone posted

Ok guys so I went to the other dealer and everything went smooth sailing. I even showed up 2 hours early to my appointment and the alignment got done quickly and accurately and the rom software done as per my request with no questions asked. Thanks for everyone's input! Just wanted to chime in and show the other users the difference between a good dealer and a shitty one.

make sure you post negative reviews of the dealer that gave you a hard time. these negative reviews (after a while) hurt the dealer in the long run...

The refuse to do work at all I agree, doesn't make sense. As to software upgrades, those are usually mandatory, I thought....remember when N54's didn't want the upgrade because it addressed a rattle while adding lag....then of course the hpfp was mandatory, it wasn't like you could refuse it....

Discuss your issue with BMWNA after reviewing your CPO warranty to make sure you have a foot on which to stand. Assuming you haven't voided all aspects of your CPO coverage by "slamming" the car, there is seemingly no reason, on the face of things, for you to have to go tot a dealer other than the one that is most convenient to you, but the Devil hides in the details.
If, and upon, receiving validation from BMWNA that you are still entitled to complimentary service from the dealership, if you want to start posting negative reviews on the WWW, fine, do so. I will offer, however, that it's unlikely that doing so will yield what you want. In the dealer's defense, and only because right now I suspect all the facts aren't in, if they don't have folks who feel capable and safe working on your car, do you really want them to work on it? It's possible that they are offering you a level of professional integrity and being honest with you by sharing that they don't feel comfortable working on your car. I know that's a stretch, but make sure you know the full nature of their refusal before you run off dissing them. If you start making negative posts and they reply to them saying that they didn't have this or that ability to work on your car and that was the reason for their refusal, they will appear more honest and trustworthy to the general public and you will have bolstered their position and reputation rather than diminished them. I have a good relationship with a dealer only 5 miles from me, but a fantastic relationship with a dealer that's 30 miles from me...sucks.
