Rallye BMW sold me a car with a lemon key

I purchased a CPO from Rallye BMW and was given two keys. At the time of delivery, one of the key was not responding well and was kind of rushed out of the door. The CA told me that my COMFORT ACCESS key just needed to be recharged and that I can also goto any BMW dealership to get it fixed if there was a problem.

After two weeks of driving the car with the other key, I decided to try the "needed recharge" key, and the comfort access was still not working no matter how long it was plugged in.

I then bought my key to Prestige BMW and they replaced the battery and it worked. However, after 1 week of using it, the battery was dead. This happened 6 times. My SA had no clue y the battery gets drained so quickly until they noticed that the key has been tampered with and it was previously opened and glued back together.

I quickly called Rallye to tell them about the problem and kept getting "I will call you back ASAP." 2 weeks with no call back, I finally called service and demanded I speak to a manager, and got sent to voicemail. He did not call me back. EVENTUALLY, someone did call me back and I explained the situation to her. She said to send her pictures and she will get back to me tomorrow.

It has been a month and I still have not seen "tomorrow". Everytime I called them to follow up, they kept saying it is still under investigation.

I am about to call BMW NA and file a complaint. Does anyone have any experience with filing complaints to BMW NA?

This is unfortunate to hear. Rallye BMW has only offered me top-notch service, so I'm not sure what's happening with you.

For the record, the Comfort Access keys are NOT rechargeable -- only the NON-CA keys will recharge when plugged in to the key slot. If the battery dies, you have to replace it.

yea i know. I was just stating that to point out how the CA didn't know his own keys.

Basically, no one wants to take ownership of providing me with a faulty key. I'm pretty sure I will get screwed out of this. They will most likely blame me or something.
The faulty key needed a battery replacement weekly.

Why didn't you go to Rallye & speak directly with the man who sold you the car?? If it was me & they were playing games over the phone, I would've strutted my ass up there & made a scene if they wanted to play hard ball over a key to a car they recently sold ~1 month ago & still under CPO

I live like 60 miles away. I would love to just go over there, but it is one expensive trip with the the two bridges and the gas.

That's why I want it is such a pain. I started noticing problems after 2 weeks. Went to Prestige weekly for like 6-7 weeks in a row. They BSed with me for 1 month, so it's like 3 months in now.

Where do you live? You should be able to go to another dealer if you are not getting satisfactory results.
When they build your (any) BMW there are 10 keys made during production....They are held at N/A. A good dealer should be able to assist you.

Let me know where you live, I know some people at local dealers

I live near Paramus. The closest dealership to me is Prestige BMW. There were great but they said they cannot replace it under warranty because it has been "tampered" with. They told me to go back to the dealership where I purchased my car, which is Rallye.

I guess I can try another dealership, but I'm pretty sure no one would cover it under warranty if there are marks of tampering.

Any help with getting a new key would be greatly appreciated.

If you know any body at any dealer that can hook me up. I am willing to travel.

E-mail that i got from them today..

"I had spoken to the Service Dept. manager, but then we had to bring Sales
into the picture, since the part would not be covered under the warranty.
I forward the pic to the pertinent parties, and they are certain that the
key was not in this condition when it was delivered to you, and will not
cover it.
You may contact your salesperson or the Sales Management team with any
further questions."

GODDAMMIT!!! I knew i was going to get blamed for this.

what if you did this, buy the key fob, swap the key thats laser cut, and the components.

maybe the seal on the old key is not good , has poor contact and its draining the battery.

By the way, one does charge comfort access keys, by placing them in the key slot."

NO IT DOES NOT RECHARGE!!

failure on my part to walk out believing him that the key can be replaced under warranty.

I did call BMW NA. They told me it is the dealership's problem. They are just the manufacturer and can't do anything for me besides filing the complaint against them.

Trust me, dude. I called like every number in their directory.

at this point i would buy key fob and try swapping the components or pay $ 500 for new key. i think thats how much it goes for
