Bloody ironic

On page 57 of the latest Retro Ford Magazine is a half page advert for Hammerite.

It states :

"Your prized possession needs the right protection"

And shows an arched MK2 Escort behind a guy in a suit, with shades holding his arm and hand out towards you.

The ironic bit ?

Hammerite have STOLEN one of my copyright images to make that advert

Should have painted my images with Hammerite it seems.

Will be getting in touch with Hammerite after the Easter break.

Didn't you have your stuff lifted before, e.g. eBay? This is the trouble with the Internet, if you have Intellectual Property it gets 'borrowed', and you get nowt. Kids copy stuff for their homework, people illegally download music (particularly pisses off a composer friend of mine), and as you've found, organisations or their hired help rip-off your work. Keep it to yourself, but Hell, even some people copy the latest BMW Nav DVDs! Very naughty.

I can't abide the attitude, so wish you all the best in getting justice.

You should also write to Retro Ford Magazine and let them know that one of their advertisers is utilizing a copyrighted image without permission.

Think you need good advice on this one. But one thing is for certain with the right brief £££$$$$. Don't think Hammerite would want negative publicity from this.

Worth finding out if this was created in house or an external ad agency first.

Initial contact has been made.

Took a power of phoning around but now have names and addresses. Then spoke very politely with Hammerite's PR department. After them asking I even showed them where the image was taken (*) and they are now following it up ....

Let's see how this develops.

(*) I have it as a wallpaper on my website. And the image quite clearly has my web address on it even if they found it posted somewhere else.

Not allowed to copy for illegal use eg to sell or give away etc. but you have after all bought the dvd with the car assuming you have the original.

I think you have every right to make a "backup" of the disk in case the original becomes damaged.

I use my backup in the car whilst my original is safely filed away (belt & braces approach).

Just use Nero and a dual capacity disk

It would be worth knowing how many magazines are displaying this ad. Have these ads been used as posters and distributed to stockists. A visit to WH Smiths magazine shelf and a local motor factors might be in order. Also ask Hammerite themselves for a truthful answer.

I spoke to a woman earlier this week who inadvertently used a Getty owned image on her website. Getty contacted her with a legal docs and was fined £1800 for the single use of the photo. Getty have 'spiders' which scour the internet for illegal use of their images.

The more locations your image has been used would stand you in stronger ground for multiple compensation charges for not seeking your permission.

I once had a graphics program that the owner of the software required you get their permission before using any graphic created by their software on your own website even if it was your own creation. It would encode a signature within the file and the company had a spider routine that would seek out offending internet graphics. Supposedly you'd get a nastygram from them if they found one. That's almost beyond the Ford Motor Company claiming copyright on photographs of people's private cars a couple of years ago. I don't remember what the name of the program was. I don't think I even have it anymore.
