Can anyone shed some light on this subject?? I am in the middle of this process and do not know what to expect when faced with giving back my car.

If you know how this program works please let me know... I have heard many things like u have to pay for the milage used; other people say that they give you a car just like yours and that they are only able to give you specially allocated cars for this program and that you can't choose any car on the dealer inventory.

I would appreciate your comments and knowledge with regards to this subject.

First thing, ask the person whom you are working with at BMW NA (or is it the dealer as liaison?) for the exact details.

There are a lot of variables, such as lease with BMW NA v. lease with someone else v. finance or cash purchase. In addition, mileage and vehicle condition may factor in.

Each deal is individual although it comes out of a template.

Means your car qualifies as a lemon but instead of going through the Lemon process you trade your car for a new one, with BMW paying part of the difference of the value of your car and the new one. Sometimes it might be an equal trade. Seems to happen to quite a few of the people waiting > 30days for their 335i fuel pump.
BMW can sell your old car without it being labeled as a lemon.

Happened once to me on my wifes minivan.

Depends on the car. Often they are indeed marked.

If you sign a waiver (like I did) that stops the lemon clock from running, then the car is never labled and it can be sold again. And for something as simple as a part on back order when the car itself normally would have been fixed in less than a day, I saw no reason to do this and let the dealership sell the car to someone else, while I got a new one

I have a feeling this is a gray area, and your end-result will differ from others depending on how good/bad of a negotiator you are. There isn't a simple "yes or no" answer to your question.

Had a friend go through it on a 3 year old E39 with an incurable defect, long after the E39 was out of production. BMW performed the calculation of the buyback price in accordance with the CA lemon law rules, even though no lemon law action was initiated by the customer. The price offered es extraordinarily generous, and was payable in check or credit against another BMW (at owner's option). Lot of goodwill was generated.

I no longer drive a 335i e92. I drive a 550i Sport. Thanks to trade-assist and OpenRoad BMW.

I still havn't posted anything on this... I should...

trade-assist. It is usually done when a vehicle has been in and out of the dealer for the same problems or even more problems than before. The car usually is at the dealer for a considerable amount of time. The dealer then calls for a BMW technical rep to check the car out and he has to conclude that the car is eligible for a trade assist. A regional manager also has to approve the trade assist. ( This process usually takes 2-3 weeks to approve). To the best of my knowledge, the client can only trade for the same car, apples for apples. If there is more options on the new car, it is on the customers additional expense. (depends on the dealer again) I have seen trade assists with more options on the new cars with $0 expense. BTW, I have not seen or heard of a 335i with a bad fuel pump in a trade assist situation.

Once the "lemon" car is repaired, BMW NA usually tries to sell the car at auction. It is very rare that it is sold at the dealer. Carffax will not show the repairs but a BMW vehicle history report will certainly show in bold letters "trade assist".

After 30 days of waiting for a fuel pump in most states you would have a new car thanks to the lemon law. BMW could choose to to trade assist as an alternative.

I recently found out a California based Trade Assist 335 with bad fuel pump issues....

It was noted in the service notes and was offered as a CPO from a dealer in the midwest. There was a note that it does not qualify as a CPO in California.

The gist of this... beware of Trade Assist or Lemons that where from out of state and are sold in your area as CPOs.

Run into this old post accidentally when googling something and wanted to share my experience. I was sold a BMW by Cunningham BMW, now called BMW South County, in the San Diego area few years ago. The car later turned out to be a trade assist vehicle and the next BMW dealer wouldn't give much at all when I tried to trade it in. I had moved 3000 miles away so I couldn't just go back to where I bought it from..... I was majorly pissed off and looked into this a little. It turned out the Cunningham guys sold it to me a month before a new law came into an affect that would have required them to disclose the history of the vehicle. No wonder I got a good discount on it. I'm absolutely sure the Bulgarian sales guy and the sales manager knew exactly what they were doing. Later their lawyer said that they had not done anything wrong and I just dropped trying to get any compensation for it. Oh, I did call BMW US and tried to revoke the service starts I gave the sales guy, ha, ha! Also, it was quite disappointing that BMW US said it's ll between me and the dealer, and their only advice to me was to sell it to a private person who could not verify the history of the vehicle....

So, lessons learned: Ask them to show you the service records of the car you're buying and verify the history. CPO doesn't necessarily mean anything. Never ever buy anything from Cunningham / BMW South County.
