I very much agree with this statement. There should be a lawsuit against BMW Canada. This is the biggest reason why I took a loss on the trade of my 335i for the M3. I just hope that the dealer fixes the wastegate rattle before selling it to someone who does not know any better.

Had my wastegates done in end of November. All they did was adjust them. $2700. And not even 3 months later they're rattling just as bad as they were before. Never thrown a code though yet. Just makes me so mad and embarrassed when i drive it. They damn well better push the warranty into Canada. Nothing like being shafted as per usual in Canada with regards to anything.

If they don't I'll just end up going with RB turbos eventually once mine have gone to hell.

Wow $2700 is steep for just adjusting the actuators.... A better route would have been to buy the new oem turbos from the states and get them installed here for about $3k...

And if it was 3 months ago, and you got it done at the dealer, I'd be shocked if there's no warranty on their work, especially having paid that kind of $.

SITUATION

BMW NA has agreed to extend, to a total of 8 years or 82,000 miles, whichever comes first, the
emissions warranties covering the Settlement Class Members’ vehicles for any failure of a turbocharger
caused by a defect in a turbocharger wastegate.

The terms of the original New Vehicle/SAV Limited Warranty and applicable emissions warranty still
apply. BMW NA will not provide warranty coverage to any Settlement Class Member’s vehicle
containing modifications or alterations to the turbocharger or its wastegates (software, hardware or
otherwise), or evidencing other conditions not normally covered under the original New Vehicle/SAV
Limited Warranty or applicable emissions warranty.

Modifications excluded from warranty coverage include any aftermarket parts that affect the
turbocharger system, or if there are other conditions that would normally exclude it from warranty
coverage.

Well I'm getting my turbos replaced as we speak and luckily covered under my CPO warranty which expires in 2 weeks. Every time I brought my car in for regular service I always had documented the rattling noise with the SA and every time I get the car back the mechanics documents not hearing any rattling noise from the engine so nothing was done for that specific complaint but after reading a few posts on here I knew the culprit were the wategates. When I took my car in 3 weeks ago for the battery cable recall and the check engine light (misfire in cylinder 3) I again documented the rattling noise with the SA. Yet again they fix my car but not the rattling noise since the mechanic can't detect any issues but the SA told me to come back to dealership as soon as the rattling noise comes back so they can isolate the issue. So I booked another appointment on Thursday so the dealer can get this issue resolved and I wasn't leaving the dealership until they were able to hear the rattling of the wastegates so I requested that the SA and Shop Foreman go on a test drive with me. Luckily for me I didn't have to go far since as soon as I started the car the rattling noise kicked in and the Shop Foreman knew exactly what the issue was. So after further diagnosis and paperwork from BMW to approve the warranty replacement my turbos are being replaced on my 2007 e90.

^ that is the way to go. Simply go in to complain about and be firm on "that rattling noise" (don't go in sounding like you know for SURE its the turbos needing to be replaced as if you're some BMW guru). They know its the wastegates.

^^^Amen to that dude. Got my turbos replaced (parts/labour) and a wheel alignment (the mechanic did a test drive one the new turbos were installed and noticed that the steering was off center slightly)done for the low low price of my CPO deductible which was $57.00. Thank god for my CPO warranty.

I went to BMW of Mississauga and asked. Only applicable to the states. I wasn't shocked, we usually get shafted anyways...

Can anyone clear up for me if my 2007 BMW 335i would be cover or only XI?

I am bringing my car in Monday for the N54 fuel pump recall, might as well complain about the wastegates too
