Depends on the limitation period - im not a lawyer but generally isnt it 12 or 24 months? You already informed them of your suspicions and tried to remedy the situation by asking them for compensation, and clearly they didnt indicate the damage on the pre-inspection paper. The tech probably took it out for a rip and damaged it on a curb or something. Small claims could be an option but depends on how much time you have, I think all the evidence is in your favour for now though.
