I've had my bulb burned out light come on a bunch of times, so I eventually just put a little dielectric grease on the bulbs, tightened them all, an no more lights I think BMWs bulb sensor is too sensative.

What symptoms did your car have to give you the rear brake wear sensor?

this is a pretty informative thread about lemons. i thought i was on step 2 of 3 for hpfp but it ended up being that my exhaust cam bearing ledge, exhaust vanos, exhause cam and bearing ledge (not the same right?) needed replacement.

well got an update, bmw called me back, they will buy-back the vehicle. waiting on the paper work and see what i will be getting back. Not even a full week, and process was very very smooth.

No lawyer. Did this all on my own. I called on Monday to BMW NA about my problem, spoke to a manager then he told me it will take 1-3 days to see if they will allow it. Then yesterday another manager called saying it needs final review which will take 1-7 days but they called today and said they will buy it back and paper work will follow. They will have a check ready when I return my car.

This email serves as notice that BMW of North America, LLC (“BMW NA”) will repurchase your vehicle in accordance with the provision of California Civil Code 1793.2 (the “Act”).

The Act provides in relevant part that if a manufacturer is unable to conform a vehicle to the applicable express warranties after a reasonable number of attempts, the manufacturer shall either replace the new motor vehicle or refund the buyer an amount equal to the purchase price paid by the buyer less that amount directly attributable to use by the buyer prior to the discovery of the nonconformity.* We will reimburse you the full purchase price less the amount directly attributable to the use of the vehicle.

If you claim incidental or collateral expenses relating to the subject vehicle, please provide me with proof of those expenses prior to the date of the exchange, and we will increase your refund check to include those amounts.

Your obligation under the Act is to deliver the vehicle to the manufacturer. the brake light probably went on because his brake pads were worn. Just regular maintananc. He has about the same miles I had when my rear pads wore out (more actually).

Congrats OP. I hope they give you a fair price on the buy back. the number of visits you had to make in a short time is pretty crazy!!

Coming from someone that works with a ton of lawyers...calling BMW first was a horrible idea. You should have gotten a lawyer involved first.

You got really lucky that BMW handled this so well.

Why? He got exactly what he wanted and he did not have to pay a lawyer $250+ an hour to do something he was fully capable of handling himself.

It worked out. FYI a lawyer would take a preset percentage again the final number from BMW, not an hourly fee. California tends to give better legal coverage.

It is always good to get a lemon law attorney involved (at least in CA). Here in CA they work of contingency--meaning they only get paid when they win a case, so in essence they only take on cases that they are fairly certain that they can win. And the lawyer doesnt take a cut of the clients check from BMW. BMW pays they directly and is separate from what the car owner gets. My lawyer got paid $1800 directly from BMW NA

Also its better to get the Lawyer involved because BMW will try to charge you for mileage, etc etc...... so moral of the story--contact a lemon law attorney before you ever mention anything about a buy back to BMW

Final update,

So i am getting all my payments back, tax, license, and they are paying the rest of my loan off. So i am not even paying 1 penny. They are not charging me for miles or anything, just gotta make sure the car is in working order :P.

Otherwise fairwell, moving onto another car.
