Is it illegal to have a radar detector....that isn't on?

Long story short,

About once every two weeks I make the drive down to Indianapolis for which it is legal to have a radar detector in the car for some of the states.

I know that they are illegal to have on in Ontario.

My questions is this:

If the radar detection system is turned off when in Ontario, is simply having the unit mounted on the windshield enough to get pulled over/a ticket/or it confiscated?

U will get pulled over and questioned about it, simply just remove it from your windshield and put it away

Not worth the hassle. Just tuck in away while in Ontario.

If cops see you while in Ontario, you may get a ticket between $100 - $400 (typical) and + 3 points + detector confiscated on the spot (I have heard the max is $1000). Although you may not have the unit on at the time, the cop can say you have possession of an illegal unit and that's all he need to justify. If you take it to court, what do you say in front of the judge to fight the charge, knowing the unit is illegal ??

+1 It's hard to fight that in court. Intent is presumed from the possession.

Sadly, I have experience with this. It is illegal to have even if it is not turned on. Luckily you'll probably never run into a situation where you get stopped just because you have a detector/jammer etc (assuming not on). However, if you get stopped for something else and they have a suspicion you have one...more trouble than it's worth. So, as mentioned, keep it off/in the glovebox in ON, imo.

Do you think there's a chance they find it on you if it's in the glove box, which is locked while turned ON?

By using a radar detector , detector? Or something similar?....

For the radar detector to be effective it has to be mounted as high as possible on the windshield unless you have the permanently mounted units that have sensors installed in the front and rear of the car and then connected to the unit which can be located under the dash or in the glove box.

I'm not exactly sure legally what would justify them being allowed to search your glove box unless you allowed them because I know they need a warrant.

My cousin is a criminal lawyer and told me if I really wanted to piss them off to carry a registered envelope in the car and if pulled over just place the detector inside the envelope and seal it. They need a warrant to search registered mail, which they would not get simply from having a suspicion of you having a detector so I guess you could get away with it like that.

Very odd because I crossed the border with my radar detector up, not knowing that they were illegal till I saw signs about it later. Not one word about it from border patrol

I ran the risk, but looking back, I probably shouldn't have.

Border patrol doesn't care if you have a detector of not. They can't even give you a ticket. They can hold you there and call the police who can give you a ticket but 99% of the time they have more important stuff to do.

They are concerned with bigger things like drugs, weapons, etc. Having a radar detector is really not what they care about.

Ahh I see. Makes sense.

Not going to lie, having the detector up saved me a lot of time between toronto and niagra falls.

Do they just ticket you or do the also confiscate it? I'd keep an old cobra or something on hand in case.

From my understanding, they ticket and confiscate the detector. I heard you can loose 3 points but I am not sure on that someone else can chime in to confirm that.

Under the HTA, if you are convicted for possessing a detector, any device that was seized by the police is forfeited to the Province and you are liable to pay fine ranging between $100 - $1000.

I think the obvious answer is if you have something illegal its no smart to leave it openly visible to the public eye haha.
