Very Unfortunate

A very unfortunate situation. This dude hit me when i was trying to avoid his already big mistake of getting on the road without seeing me coming. He's car is not registered and he didn't have insurance. Just great.

Boys ... check your insurance right now. I see this everyday at work. Make sure you guys all have UM (uninsured motorist) Bodily Injury and Collision. That way you wont have to pay out of pocket when its not your fault.


Costa you have more patience than I do. If someone did that to my car, the attorneys I work for would have to bail me out of jail for beating that guys ass.

UM, if I remember correctly, covers both un-insured and under-insured motorist for both medical and personal property damge (or you can modify the policy to reflect such).

If you have a car worth well more than the state minimum coverage ($10K) and you don't like waiting months to years of suing someone and waiting for them to pay to get your repair costs back this is very valuable.

Just remember, someone with state minimum coverage the insurance is only liable for that coverage amount. It is your responsibility to carry coverage (medical and personal property) that will "make you whole" if you get into a wreck. If not, you're gonna have to fight for your money (assuming you'll even get it).

UM in the state of Louisiana for property damage is a PITA. You have to get an affidavit and all this other shit. Having UM for bodily injury is a must but please do not have UM for property damage. Make sure you have collision instead of UM property damage. That way you dont have to go through the dmv and get affidavits and all this other stuff to slow you down.

Louisiana state minumum is 15,000/30,000 per accident.

Someone hits your 60k car. You better hope your insurance is going to cover the rest.

I personally have 100,000/300,000 and I dont think thats enough. Im consider uping that to 250,000/500,000

OK, so maybe it wasn't explained to me correctly...

I was told that UM has two sub levels.

1) Medical - Covers medical injury costs greater than what the other person has covered. So if the person who hit you has minimal or no medical insurance coverage, the medical coverage of you UM policy will cover you and those in your vehicle.

2) Property - Covers collision damage that costs greater than what the other person has covered. So if they have minimal or no coverage then the UM policy would cover your repair costs.

Is that right (or close)?

Yes that is correct HOWEVER... you do not want to have UM for PROPERTY damage. You NEED to have it for bodily.

Having UM property is the worst thing. (but its better than not having anything) It takes sooooo much longer there is so much more paperwork involved and steps and procedures to go through to get your car fixed. You NEED to have "Collision" instead for PROPERTY damamge. In the state of Louisiana collision will take care of your car if an uninsured motorist hits you.
