I was wondering if anyone on here knows about the laws surrounding marriage...

When getting married, if the guy has a property on his name and some savings in his name in a personal bank a/c, will these be "halved" in the event of a divorce?

What about taxes? etc...

In summary,

I would like to know what are the benefits and drawbacks of getting married from a legal perspective?

and what would happen in the eventuality of a divorce? etc

I believe in most cases it's up to the judge at the court proceeding (if it went to court that is)... they decide what is 'fair' in their opinion given both your situations.

If your that worried, get a pre-nup... or just don't get married... not sure there's much in the way of positive tax breaks nowadays although could be wrong on that one, never had to find out!

end of the day she will get 50% unless you can prove she was out to get you just for the money, everyyear she is with you the harder it will to prove, i wont not worry about it, i have plenty of firepower to give my wife the shits if she plays away

pre-nups are not legally binding in the UK. Generally in a divorce or split of common-law marriage things are split 50/50. Children can skew this, as can relative contributions if they differ enormously. Divorce is expensive however its done.

I don't believe that is wholly accurate buddy, wasn't there a case in the news the other day of a pre-nup holding up in the UK ?

If that's the case, I didn't see it. In the UK you can't change statute, common or civil law simply by writing a note saying "this bit doesn't apply to me".

I suppose if you did have a pre-nup then the judge might consider the agreed intentions in a dispute when using his discretion to make a judgement but they're not legally binding per se.

There was a case of a pre-nup holding up but the Court went a long way to distinguish this case from the norm.

Course, you could always get married in Italy - 2 types of wedding there:

1. What is yours up to the wedding is your own and anything bought after is joint, or,
2. What is yours is your own.

What the UK Courts would make to that contract remains to be seen - I imagine that they would bend over backwards to shaft you anyway ........

No expert but some evidence suggests that divorce courts are definately 'anti-men' and you could be hammered if you divorce if; you earn more than your wife and have a decent pension fund and/or if children are involved. Just ask 'Fathers for Justice'. I am not so sure that it is a 50/50 split necessarily and it will almost invariably be split in favour of the woman. I have divorced colleagues who have walked away with very little compared to their former partners and are worse off by £100,000s generally due to 'sharing' the proceeds of the marital house sale and having to forgo a large portion of their occupational pension funds.

If its the case I am thinking of then it was a divorce between a German woman and French man and in both countries pre-nups are legal.

The case was heard here in the UK and it was decided to uphold the pre nup and the Frenchie lost out on millions.
