Rejecting e93 from BMW?

Hey guys just looking for some advice please.

Recently purchased (1st Feb) a 59 reg e93 from a bmw dealer in London. Drove back to Birmingham in heavy rain and the next day noticed water in the boot. Cleaned it up and called bmw birmingham (2nd feb) to report the problem. For the next 3 days I drove the car and it didn't leak again. Even had the car wash guys pressure wash the seals etc to test them.

However after driving on the motorway In heavy rain I checked the boot and a small amount of water had leakedin. So it seems it only leaks when driving in heavy rain on the motorway.

Anyway birmingham bmw gave me a call and said as water ingress is not covered under AUC if they fix it ill have to pay, so was told to contact the dealer I got it from.

Orginal dealer agreed to take the car and fix it, they had it for 10 days in total and said they cleared the drains and changed a few clips. I drove home again In heavy rain and the leak is still there but seems its much worse now.

I'm looking for advice what to do now? Can I reject the car? (Tbh I love it and don't want to) Can I ask them to pay birmingham bmw to fix it? As birmingham bmw are fantastic and I'm sure they'll do a better job. Or will I have to give it back to the original dealer again who is 150 miles away?

Also is there anyone I can contact above the dealership? Would a call to bmw UK and making a complaint help?

I've had audis in the past and if Audi UK are contacted they usually give the dealership in question a right kick up the ****.

Yes you can reject the car and get your money back if they cannot/will not resolve it.

Call BMW UK regarding the issue and explain you want BMW Birmingham to carry out the work as the original dealer hasn't been able to resolve the issue after 10days.

Agree, after reading every thing properly again,,,, But go back to the original dealer and tell them the problem is still there....

Called the dealer again, spoke to the used car sales manager and his said his going to speak with his buisness advisor and get back to me by 12. I dont want to reject the car but if they dont sort it out thats what im going to push for.

Yes i was thinking this but the car was purchased at a very good prive, almost £2000 less than its worth. So i dont think they will mind taking it back too much.

its the sellers responsibility at this point. Make a note of the issues and keep on at them. I am sure that a main dealer will sort it out for you - its not a back-street cowboy bunch.

Well I've always negotiated the price down from what they say and they do have a lot of margin in them depending what's needed to get it to forecourt state. Sometimes they will even hold back on work to see if a potential purchaser will ask for things to be sorted. Hence why when you go to the dealers to see a forecourt ready car they still have slight scuffs or kerbed wheels etc sometimes.

They won't want the car back no matter what.

Well I don't know how you do it? First time I tried to get money knocked off a car at BMW strastone Derby and stratstone Doncaster they wouldn't come down a penny. They lost my business. They keep making out that's why the cars are like £18,372 because the price is exactly what it should be.
I know BMW Derby have good sales though and as soon as I walk away 5 more people are lined up behind me...

Just an update, called the dealer and was told no one is avalible to speak to me. Asked for used car manager, genral sales manager or buisnes adviser. Was told all 3 are in a meeting with bmw uk.

Then called i called bmw uk, the guy basically said we cant do anything they are just a franchise of ours, speak to the original dealer.

I said they are using your bmw name, i found the car on "bmw used approved cars" not the dealers website to which he replied we only let them advertise we cant do anything. i said, can you call them and get them to sort it out, he replied no we cant tell them to do anything. I was so close to telling him to just ****Off as he was useless.

now im just waiting for a phone call i shouldve had at 11am.

as above, chill out dude, its not a serious engine problem stopping you from using the car for example ,its a minor water leak thats not caused you any serious issues yet. As the advisor says, its a franchised buisness and not really anything to do with BMW UK themselves, an act of gross negligence hasnt yet been commited, you only reported the issue this morning.

Thanks for the advice guys, your right its best to stay calm and i will. Still not had a call from the dealer.

Not sure what to do at this point, if the dealership wont even talk to me how am i meant to get them to fix the car?

Is there any rules in naming dealerships as i really want to name and shame these guys.

To be fair, if they're all at a meeting what can you expect them to do? These things happen.

Most companies are now pretty wise to customers threatening to throw their toys out of the pram to get their way and it's not as effective as it used to be.

It's a fairly minor fault that's not uncommon on the E93, it's worth looking in the battery tray as I know some people have had issues with that being wet and damaging things.

I also didn't think a car that old could be approved used?

I expect him to call me back when he said he would. You say its a minor problem but this "minor" problem shouldve been found during the comprehensive vehicle inspection.

They had the car for 10 days and didnt fix it, they know there is a problem but for what ever reason didnt fix it.

Also for those who said its a "minor" problem. This minor problem can cost thousands to fix if the roof seals have to be replaced.

I don't think they do a motorway run in torrential rain which is the circumstances under which you found the problem is it not?

The seals will be replaced man... Jheeeeze it's one day give them chance!
