Check with the State Attorney's Office of NH and see if that's legal. Often times, it's not.

Hey Diamond, to keep you from having to bump this thread again I'll ask a question. Just how the heck did you feel pulling this stunt? Did it bother you at all? We beat the hell out of dealerships but say nothing when someone waits until the last minute to back out of a deal. Couldn't you at least have tossed the dealer a bone by buying the M from him?
Or do you consider this a screw or be screwed world?

^ i know diamond personally and if you knew how little more he is paying to be in that m3 i think you would not be saying such remarks. oh, and you must clearly work for a dealership, because i think you are the first person who has ever felt bad for them.

+1 LOL'ed

It's a buyer's market right now. Whoever offers the lowest price wins. At the end, loyalty to a particular dealership doesn't pay off.

business is business.. the dealership i ordered my car from only had two M3 coupes in stock, both well over 65k.. i knew no trades between dealerships would occur (they are having a hard enough time getting them off the lots).. and lastly, my 335i CA was all about the money, he didn't care about following up with me.. i had to be on his ass for everything

with that being said i feel i did the right thing buying the M3 from a dealer with a better inventory, an M3 which was affordable for me.. and a CA who knows how to treat his clients... so clearly the 335i dealer had it coming

Let me turn your statement around. Let's say it's a seller's market. By your situational ethics reasoning the dealership should then have no loyalty to their customer. They agree to sell you an M3 for 62K but the next guy thru the door offers 64K and so it's OK for them to tell the first guy to take a hike? I don't think so. I learned at an early age that a man is no better than his word. On 10/28 the OP backed out of a deal on a car arriving in three days. No I don't work for a dealership, never did. I guess I just believe that when you say you're going to do something, you do it.

You think that doesn't happen!? Remember what happen to that poor guy who won the E90 M3 on eBay? You are a little naive, aren't you? That kind of shit happens at the stealership all the time.

I don't know for sure the laws in NH, but in CA, you owe no one nothing until you signed the official paperwork to take delivery of the car. All deposits are refundable unless it is a really weird color combo that they will have a hard time moving. Last I checked, a fully loaded, 6-sp, Monaco Blue on Saddle Brown E92 is not a weird combo.

You're right Kev it does happen and when it does we post about how much we hate dealerships for doing it. But it's OK for us to do it to them?

I don't know the law either. What concerned me was more the ethics of cancelling at the last minute with a "so what" attitude. The law says what you have to do. A sense of ethics tell us what is the right thing to do. If what the OP did is OK with you, and apparently it is, then I have no argument with you. Just don't expect to always be treated fairly yourself. Legally yes, fairly no.

Really have no intention to play nice / fair with the dealership. It's a cut-throat world we are in after all. No one plays nice anymore unfortunately.

Hippocratic oath also says do no harm, but we cut people up all day long......
