Need Help On Buyback

Ok, so since I had another long ass crank start last night, it obviously telling me that im done with my car. 3 fuel pumps in 6 months is some real fun with the car.

So this morning i called up BMWNA customer relation to file a buyback.

from now on, I will use this thread to keep track of everything I do and keep everyone posted.

If you have an experience with a buyback before.... please chime in... Im totally clueless of how this thing suppose to work

Things and Resources I still NEED !

1. A lemon law attorney

2. Stock OEM rims
(I will need to borrow it from someone... if anyone can help me out on this please PM me. I will give you back the NEW set off my up coming 08' E92) DONE ! THANKS Crimson92

3. more knowledge on how this buyback works

4.... I dont know....


here it goes

Day 1, 2/11/08

Called BMWNA CR at 9am EST. and filed a buyback

lady told me that she will contact the service manager @ Shelly BMW to see my vehicle history and should get back to me tomorrow or so.

Called up my trusted sells Yi-Wen @ Shelly.

He basically explained the general process of the buyback.....

not much things happened on day one....

Also learned that there are things that need to be done with my car if it is really going back.

Received no calls from CR or SM.

Day 2, 2/12/08

called CR 3 times and she didnt answer, no response

called Yi-Wen and told him my concern and wish to have him check in with the SM see if he/she gets the message.

BIG TAHNKS to Crimson92 and slubu for the support

I now gets 2 different opinion on how I should proceed with my current fuel pump

1. take it in and have it fix for another mark on vehicle history asap

2. take it in after the CR calles back and tells me watup... (accroding to my sells)

1:30pm SM from Shelly called in and left a vm coz i was in class

call back the SM and schedule an appointment, next wed. since i wouldnt have time past Wed and tomorrow is sort of a rush.

sounds likea nice guy but yet he also sounds clueless

he even says this in my vm "Apprently you are frustrated and i really appreciate that..."

final note for the day, car will be in next Wed., will keep looking for lawyer.

I now need someone over 21 to accompany with me in order to sign off a loaner for me, pm me if you can help out

Day 3, 2/13/08

Continue search for lawyer and gotta call Yi-Wen later to update the situation with him

Will call CR to ask about how things will go from this point if she answers it.

Just called up the SM and see what's up and his response was "people from the factory is already involved with this situation"

Sounds like some legit bs, since it's not even stated clearly and when he has no clue as I asked how things will proceed
from this point

now im afraid that he's going to say this car is fine blah blah blah after the inspection .....

Day 4, 2/14/08

I'm worrying about some tricks the SM might play on me....

i.e. fixing the car without even telling me and said there's no problem etc. etc.

now im looking at the receipt they give back to me, it never states the part # or anything regarding the fuel pump parts.

Im really wondering if they did replace it or not

spoke with 3 lawyers

one said i dont have a lemon case since i dont have enought repaits yet

one said he will look at the document and it should be a case

one said he had done many 335 and this is a promising case

Just spoke with the guy that had experience with 335
he sounds more legit than the other 2, he knows where the problems are and will assisit me with the buyback w/o a penny out of pocket

so the conclution is, even tho there might be mileage deduction but in my case, it will be very small.

It's all because my FIRST fuel pump failure is @ 2000 miles.

Mileage deduction is all based on the FIRST lemon issue.

Im was about to bust out HELL YEAH when I heard the guy explained it on the phone.

Day 5, 2/15/08

BMWNA CR woke me up w/ a phone call, glad I had a chick otherwise i would've been pissed if i got a morning call from some dude

Updated the situation with her and I found out that the BMWNA field technician is going to look at my car on this visit instead of just Shelly's (At least thats what she told me).

Also, the SM seems to be the guy who will decide how critical my car condition is.

Well, if he says some bs, the next thing he will get is a phone call from my lawyer....

who am I joking.... my lawyer is gotta call him anyways...

Day 6, 2/16/08
swaped rims

crimson92 also took my kidney

Day 9, 2/19/08
finishing up the car

Day 10, 2/20/08
car is turned in to Shelly for check up

i listed a load of problems

heard the "factory technician" is going to check the car

had a red tag on the car that says first priority or something like that, needs xtra attention

thanks for Nabil, i got a E91 328 as a loaner.

that thing has a BIG moon roof and i love it, it feels like a convertible LOL

nothing else really impressed me.

the door lock is awfully loud for some reason, sounds like a Honda if you ask me.

now im officially driving a pimp wagon.

Day 11, 2/21/08

SA from Shelly called in and reported that field technician is expected to look the car tomorrow

mean while, the whole B pillar of the car is going to be replaced due to some cracking noise i reported twice

Day 16, 2/26/08

Shelly reported that there is NO PROBLEM on the vehicle

Day 18, 2/28/08

Got the car back from Shelly yesterday

they reported a failure to duplicate the problem while under diagnosis and no code was thrown

i also reported the problem with the noise in driver side B pillar and the problem with my sterring (it makes a noise once it is fully turned to the left)

BOTH of those problems are GONE even though they reported failure to duplicate the sterring problem and B pillar is nationally back-ordered

back to the fuel pump.

I noticed that my engine warms up ALOT more faster than before.

It used to take 15+ miles for it to reach 230-240 range

now it only takes <10miles.

I know this because my apartment is 5 miles away from school parking lot.

I dont know what they have done to my car but I encountered another unusual CRANKING this noon when i was about to leave teh school parking lot

I now, have to say. Shelly's Service Department is NOT HONEST in what they are doing.

They told me they replaced nothing but yet, my car obviously drives different than before

I am now taking legal action on this issue

Day 21, 3/2/08

ALL REPAIR INVOICE are now in the lawyer's office to be evaluate on Monday

mean while, another long crank cold start this morning.

cant duplicate the problem eeh Shelly?

Day 25, 3/6/08

got 2 different opinions from different lawyers

one wants me to file it right now

and the other said I can enjoy the car for now and play the game when the fuel pump is really bad so they cannot deny the problem

Im still considering both circumstances.

Day 32, 3/13/08

filed a "Demand Pkg." through my lawyer to BMW

might take up to 30-40 days to hear back from them


Day 40, 3/21/08
Shelly's SM just called in and seems to be in a panic.

I guess "someone" called him regarding the issue of my car.

Might either be my lawyer or someone from BMWNA again

Day ???, 10/28/08

BMWNA announced that they ARE GOING TO BUYBACK the car

I have all my service history in paper document. all of them states clearly "high pressure fuel pump failure. Replaced."

keep the pressure on them! we had to deal with Nissan on a buyback last month (and it was a pure headache) about the wrong car getting delivered (08 350Z base instead of Enthu). Though my matter is different than yours, i bet BMW Affairs will say talk to the dealer about this matter and they cannot get involved. Things will change about that if u keep the pressure up.

Thanks for sharing the experience, I think BMWNA is gotta be involved no matter what since a dealer cannot buyback a car.
