got pulled over last night :(
so i was going home last night very drunk. One of my friends was driving my car, he had a few drinks, but he wasn't "drunk" the police did arrest him and let me go, but they took my car and put a 30 lock on it. He said i would need to go to court to get the car back. Does anyone know how to approach someting like this? and who do i need to talk to. to get the car back. thanx guys

Take the bus and stop being stupid. Works every time. There should be no tolerance for drunk driving, buzzed driving, or high driving. |

Maybe call the police station where the officer works out of, county office I guess? I'm not even sure what a 30 lock is...i've never been through any of that.
I'm guessing you could easily get the car back since you weren't the drunk driver - you should be able to, don't know why you have to go to court for that, thats your friends problem (b/c he was arrested). Call that county police station and tell them your car was confiscated and had a 30 lock put on it and ask them how to get it back. Don't tell them why or that you or your friend was drunk. If they ask, tell them you were sick and a friend was driving you home. Just try not to mention the drunk bit. Then when you've got your car back (don't hate me, i'm a nice guy) learn your lesson and never let anyone else drive your car, and certainly don't drive drunk! be safe, and good luck gettin it back |

This doesn't sound right, the driver doesn't own the car, I don't see how they can take it??? It doesn't work like that in MD. Call the officer any way lot of times we are more willing to talk when we are off the road.

In some states, if you allow a person to drive your vehicle when they are under the influence of alcohol/drugs and you are in the car, you can be arrested It sounds crazy, but it's true.

It will cost you $1000 but save you x10 down the road. Go on the internet and start searching for a super duper lawyer whose area of expertise is DUI. Do not select the ambulance chasers that are agressively advertising on the net. Go for a serious lawyer with deep inside knowledge of the system. There may be lawyers here on e90post that will help you find what you need. |

Just curious, how do you know your friend wasn't "legally" drunk? Did you give him a Field Sobriety Test (FST) Did you take a blood or urine test from him?

Never heard of this, it would be tough to prove in court, because you as a normal person are not trained to know whether someone is drunk or not... Unless it was at the point where the person was falling over.

One beer will not even get you close to leagally drunk. I weigh 200 if I drink 4 mixed drinks i'm at a .04 or so. Even if you were 100lbs 1 beer would put you at a .03 or so.

yeah u r probably right.... and my friend was fine.... the reason we got pulled over to begin with was b/c he didn't stop at a read light before he made a right turn.... it was obvious there was no cars , but that's why we got pulled over

The only thing the prosecutor would have to prove is 1) That you are the owner of the vehicle 2) You were in the car when the vehicle was being driven. More importantly, why would you allow your "impaired" friend to drive your $50k and endanger the lives of innocent people

from my experience its an expensive pain in the butt because you have to pay the police department for some paper to release the car, then pay the towing company for towing it, and pay for the amount of days the car was with the towing company......
