We would suggest speaking with the Service Manager of your local BMW retailer to inquire if the issues you are experiencing would be covered by the warranty extension listed on the document you provided. The Service team is in the best position to assist you from this point forward. Ya unfortunately now I am over the 82,000 KM on the car so even if it does, I won't be eligible. Anyone know how to roll back kilometers on a BMW? Just joking..... but not really.

This Service Information bulletin supersedes SI B01 02 12 dated June 2012.
SUBJECT N54 Engine Turbocharger (Wastegates Only): Emissions Warranty Extension to 8 Years/82,000 Miles MODEL E60, E61 (MY 2008, 2009, 2010): 535i including xDrive E71 (MY 2008, 2009, 2010): X6 xDrive35i E82, E88 (MY 2008, 2009, 2010): 135i E89 (MY 2009, 2010): E89 – Z4 sDrive35i E90, E92, E93 (MY 2007, 2008, 2009, 2010): 335i including xDrive INFORMATION All issues relating to the last-minute appeal have been resolved and the new effective date of the settlement is July 11, 2012. The court-approved settlement provides the following relief to the Settlement Class Members’ vehicles listed above. SITUATION BMW NA has agreed to extend, to a total of 8 years or 82,000 miles, whichever comes first, the emissions warranties covering the Settlement Class Members’ vehicles for any failure of a turbocharger caused by a defect in a turbocharger wastegate. The terms of the original New Vehicle/SAV Limited Warranty and applicable emissions warranty still apply. BMW NA will not provide warranty coverage to any Settlement Class Member’s vehicle containing modifications or alterations to the turbocharger or its wastegates (software, hardware or otherwise), or evidencing other conditions not normally covered under the original New Vehicle/SAV Limited Warranty or applicable emissions warranty. Modifications excluded from warranty coverage include any aftermarket parts that affect the turbocharger system, or if there are other conditions that would normally exclude it from warranty coverage. |

I received the yellow engine light and took the car in. 30FF was the code. The car was bought in Calgary and not covered by the warranty. Confirmed that if the car was bought in the USA then the warranty would have applied.
$5349 to fix. I called BMW Canada (which is not part of BMW North America?!) at 1-800-567-2691 and they told me to contact transport Canada to complain. WG stuck open and dead turbo. |

warranty will not cross border, canadian registered car now. your sol like the rest of us, unless you bought extended warranty.

so once they find out your car was registered with a canadian licence plate,they are you gonna decline the warranty?is that what you've gone through?

i have not personally gone through that, its just an assumption. it was a class action lawsuit filed in the states, i believe they have a list of all eligible vins, once yours would be sent back to bmws head office for approval to continue with waste gate replacement they would see you car is not eligible as it is registered in canada. dealerships cannot just replace the wastegates without first having approval from bmw NA

The 'repairs' did not cure the defect. The engine went into limp mode yesterday outside of XXXXX. I'm now told the solenoid failed and that the repair will be something in the nature of a thousand dollars. And, with respect to the sudden loss of power shit that BMW finally disclosed in its March 2013 recall, I already dealt with that. The car suddenly lost power at highway speeds on the XXXX in XXXXXXXX in 2009. The Dealership lied about the cause, now I know it was yet another latent defect.
The 2008 BMW 335i is a dangerously defective car that poses a non-trivial threat to its occupants and to third party users of the highway. I'm genuinely of the view that people might get killed. The power defect, which is the one I experienced in 2009, is by far the most dangerous - the entire car is suddenly without any sort of power, steering becomes dangerously hard and there are no lights, breaking is substantially more difficult and you essentially lose control of the vehicle until it comes to a stop. There ought to be criminal charges. The latest 'recall' was issued pursuant to the Motor Vehicle Safety Act http://www.tc.gc.ca/eng/acts-regulat...ts-1993c16.htm
